SECTION 7A - CONSUMER CONTRACTS REGULATIONS 2013 (DISTANCE SELLING)
This section applies to bookings made through the TaapCraft platform, which constitute "distance contracts" under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ("CCR 2013").
7A.1 Trader Obligations Under CCR 2013
All Traders using TaapCraft must comply with CCR 2013 by:
- providing clear pre-contract information before a booking is confirmed
- displaying accurate pricing including all mandatory charges
- setting and displaying their cancellation policy clearly before checkout
- providing their business name, address, and contact details
- describing the service to be provided in sufficient detail
- specifying the total price including VAT and any additional fees
- stating any delivery or performance timescales
TaapCraft facilitates the display of this information but Traders remain solely responsible for its accuracy and completeness.
7A.2 Cancellation Rights (14-Day Cooling-Off Period)
Under CCR 2013, Consumers generally have a 14-day cooling-off period to cancel a distance contract without giving a reason.
However, for services:
- the right to cancel ends once the service has been fully performed, if performance began with the Consumer's prior express consent
- if the Consumer requests that a service begins during the cancellation period, they may lose their right to cancel once the service is complete
- for services that begin immediately at the Consumer's request, the Consumer must acknowledge they will lose their cancellation right
7A.3 Cancellation Policy Display Requirements
TaapCraft requires Traders to:
- set their cancellation policy within their profile/listing settings
- ensure their policy is displayed clearly before checkout
- specify any cancellation fees, notice periods, or conditions
- explain how refunds will be processed and any timeframes
The app will display the Trader's cancellation policy to Consumers before a booking is confirmed.
7A.4 TaapCraft's Role in Refunds
TaapCraft:
- facilitates refund processing through our payment systems
- does NOT guarantee refund outcomes or eligibility
- does NOT determine whether a cancellation qualifies for a refund
- does NOT mediate disputes about cancellation terms
Refund decisions are made by:
- the Trader (based on their stated cancellation policy)
- the payment provider (for chargebacks and disputes)
- the insurer (where applicable, for insured claims)
7A.5 Pre-Contract Information Checklist
Before a booking is confirmed, the following information must be available to Consumers:
- main characteristics of the service
- identity of the Trader (business name)
- Trader's geographical address and contact details
- total price including VAT
- any additional delivery or service charges
- payment arrangements and timing
- Trader's cancellation policy
- expected performance date or timeframe
Traders are solely responsible for providing this information. TaapCraft provides the platform infrastructure but does not verify the accuracy of Trader-provided information.
7A.6 Exceptions to Cancellation Rights
Under CCR 2013, the right to cancel does NOT apply to:
- services fully performed with Consumer consent before the cancellation period ends
- goods made to the Consumer's specifications or clearly personalised
- urgent repairs or maintenance requested by the Consumer
- sealed goods that have been unsealed after delivery (where applicable)
7A.7 Important Disclaimer
TaapCraft is a marketplace facilitator only. We do not provide the services listed by Traders and are not a party to any contract between Consumers and Traders. While we require Traders to comply with CCR 2013 and display their cancellation policies, we cannot guarantee Trader compliance.
If you have a dispute about cancellation rights or refunds, you must resolve this directly with the Trader. TaapCraft may facilitate communication but does not determine outcomes.
